1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of ChartenAI (“the Service”), operated by Charten Labs (“we,” “us,” or “our”). By creating an account, subscribing to a plan, uploading chart screenshots, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of the Service

ChartenAI is a Progressive Web App that allows users to upload screenshots of financial charts across supported asset classes — Forex, Stocks, Crypto, Futures, Commodities, and Indices — and receive AI-generated, educational market-structure analyses. The Service may combine multiple timeframe reads, highlight key price zones, and present conditional trade scenarios together with a calculated confidence estimate.

For Forex instruments only, the Service may incorporate economic-calendar context sourced from ForexFactory to enrich risk notes. No real-time price feeds, broker connectivity, or trade execution is provided.

3. Educational Purpose Only

ChartenAI provides AI-generated, educational chart analysis only, including calculated confidence estimates. It does not provide financial advice, investment recommendations, or trade signals. All trading decisions and their outcomes are the sole responsibility of the user.

You should consult a licensed financial advisor before making any investment or trading decision. Past performance, chart patterns, or confidence scores shown by the Service are not indicative of future results.

4. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

• Uploading content you do not have the right to use or share;
• Attempting to reverse-engineer, scrape, or abuse the AI pipeline;
• Creating multiple accounts to circumvent usage limits or trial restrictions;
• Using the Service for unlawful, fraudulent, or harmful purposes;
• Removing or obscuring watermarks, disclaimers, or compliance notices.

6. Subscription Plans and Payments

ChartenAI offers Free trial, Pro, and Unlimited subscription plans. Paid plans are billed in advance and processed through third-party payment providers: Stripe, Paystack, and USDT cryptocurrency payments on the Ethereum (ERC-20), TRON (TRC-20), and TON networks.

USDT payments are reviewed manually before activation; plan access is granted only after our team confirms receipt. All payment processing is handled by the respective provider, subject to their terms and privacy policies.

Subscription fees are non-refundable except where required by applicable law or at our sole discretion. You may cancel your subscription at any time from your profile or billing settings; cancellation takes effect at the end of the current billing period.

7. Intellectual Property

Charten Labs retains all rights, title, and interest in the Service, including its software, designs, trademarks, logos, and AI-generated report templates. You retain ownership of the chart screenshots you upload. We grant you a limited, revocable, non-exclusive license to use the Service for your personal or internal business purposes in accordance with these Terms.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any analysis is accurate or complete.

9. Limitation of Liability

To the fullest extent permitted by law, Charten Labs and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or trading losses, arising out of or related to your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Charten Labs from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately, but provisions related to intellectual property, disclaimers, liability, and indemnification will survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Charten Labs is incorporated, without regard to conflict of law principles. Disputes shall be resolved in the competent courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
